@slightlyflightyone ehhh, that's like, a really murky grey area, but...if it's completely out of anyone's control, then i'd argue yeah, it'd be safest to not be allowed near others.

isolation and stigmatization would definitely do more harm tho. Like, who's in charge of "stopping" them and how? Treat them and approach them on a personal basis would do better as a rehabilitative solution. Criminalizing and marginalizing is not only inhumane, but also damaging to everyone.
