@mxsiege@octodon.social Yes there is a punishment of fraud, but it's still not a stat dec. A stat dec is a specific legal thing that requires the presence of a lawyer or magistrate or similar.

And I'm not super happy about the threat of punishment in that context either.

@mxsiege@octodon.social I didn't make a stat dec when I changed the gender on my passport. Unless you mean the general "I promise this information is correct" thing which isn't a stat dec because it's not made in the presence of a witness?

@mxsiege@octodon.social Perhaps. But I consider the fact that they chose to emphasise the prosecution angle in their statement rather chilling, especially when considered in context of the fact that TERFs have been pretty successful in courting the attentions of the Scottish Parliament.

@mxsiege@octodon.social but that's my point, ManFriday's actions are ultimately pretty harmless compared to the risk of TERFs pushing for a trans person to be prosecuted for alleged fraud

@mxsiege@octodon.social Are anti-trans people really going to cheat the system in protest? TBH if they did they can fill their boots in my book. I'm more worried about the possibility of detransitioners being accused of making a false declaration. Or if someone NB tries to get a GRA because "F" fits better than "M" but that's deemed fraudulent.
