@lizardsquid That's completely incorrect according to my reading of the terms. You don't retain your right to sue at all. The "arbitration fee" is a red herring, it would generally be much less than the stakes of the lawsuit. Finally the thing about Discord being able to sue you is also a red herring - they were always able to sue you. Arbitration heavily favors corporations over individuals, even more so than courts.

@lizardsquid Also they cleverly include the following topics to be exempt from the arbitration requirement: "patents, copyrights, moral rights, trademarks, and trade secrets and claims of piracy or unauthorized use of the Site". These are exactly the things Discord wants to sue *you* for, rather than the other way around.
You're completely wrong on every count.

The most important part of my toot was the part that says "read the terms very carefully"
If I had more than 500 characters available to me, I would have emphasised that I'm not a lawyer and even if I was I'm more familiar with my country's legal system than the US, but unfortunately I ran out of characters.

@lizardsquid Thanks for this! I heard about sending them an email to opt out, but I was very skeptical (stuff like this I've seen before with other things and it was bogus). What a good read; was nice to read their response and stuff :3

Some disclaimers I wanted in my original toot but ran out of characters:
‣ I'm not a lawyer. Don't take my advice assuming I'm an expert (but likewise don't do the same for the other advice floating around!)
‣ I'm not in the US, so the US legal system is not something I'm familiar with in any intimate way
‣ Read the Terms carefully. Come to your own conclusion. Or better: find someone who does actually know what they're talking about for legal advice
